The city stopped placements with the agency, Catholic Social Services, after a article in The Philadelphia Inquirer described its policy against placing children with same-sex couples. The agency and several foster parents sued the city, saying the decision violated their First Amendment rights to religious freedom and free speech. The city was entitled to require compliance with its nondiscrimination policies, the count said. Allowing foster care agencies to exclude qualified families based on religious requirements that have nothing to do with the ability to care for a child such as their sexual orientation or faith would make it even worse.

The US supreme court on Monday ruled in favor of a Colorado baker who refused to make a wedding cake for a gay couple for religious reasons, although the justices avoided a wider ruling on religious exemptions for businesses. Charlie Craig and David Mullins went to the Masterpiece Cakeshop in Lakewood, Colorado , in July , only for owner Jack Phillips to say he would not provide a cake for a same-sex couple. That requirement, however, was not met here. Ruth Bader Ginsburg and Sonia Sotomayor dissented. The two most liberal justices said they would have upheld the finding of the commission, which decided that Phillips violated the Colorado anti-discrimination law that bars businesses from refusing service based on race, sex, marital status or sexual orientation. Mullins spoke to reporters on a conference call. Appeals in similar cases are pending, including one at the supreme court from a florist who did not want to provide flowers for a same-sex wedding.
